Terms of Use

IMPORTANT: This is a legal agreement between you ("You," "User," or "Your") and Oncoo (referenced herein as "we," "us," or "Oncoo" or with "our") that applies each time you use or access the Oncoo website (oncoo.app) or mobile application (collectively, the "Platform"). Please read these Terms of Use ("Terms") carefully as they govern your use of the Platform.

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.

1. License Grant & Restrictions

License Grant

Subject to your compliance with these Terms, Oncoo grants you a personal, revocable, limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Platform for your personal, non-commercial use.

Restrictions

You may not:

  • Modify, copy, distribute, transmit, display, reproduce, publish, license, or create derivative works from the Platform
  • Use any automated system (including "robots," "spiders," or "scrapers") to access the Platform
  • Reverse engineer, decompile, or disassemble any portion of the Platform
  • Remove or alter any copyright, trademark, or other proprietary notices
  • Use the Platform for any commercial purpose without our express written consent
  • Frame or mirror any part of the Platform without our prior written authorization

2. Eligibility & User Obligations

Age Requirements

You must be at least 13 years old to use the Platform. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you represent that you have reviewed these Terms with a parent or legal guardian and they have agreed to these Terms on your behalf.

User Obligations

You agree to:

  • Provide accurate, current, and complete information when creating your account
  • Maintain and promptly update your account information
  • Comply with all applicable local, state, national, and international laws and regulations
  • Maintain the security and confidentiality of your account credentials
  • Immediately notify us of any unauthorized use of your account
  • Be solely responsible for all activities that occur under your account

3. User Accounts & Profiles

Account Creation

To access certain features of the Platform, you must create an account. You are responsible for safeguarding your password and any activities or actions under your account.

User Profiles

Your profile may be visible to other users of the Platform. You control what information you include in your profile, but please be mindful that:

  • Public profile information is visible to all Platform users
  • You should not include sensitive personal or health information in your public profile
  • Your profile represents only that you have registered with Oncoo
  • Oncoo makes no representations about the accuracy of information in user profiles

Important: You may not impersonate another person or entity, or falsely state or misrepresent your affiliation with any person or entity.

4. User Content & Community Guidelines

User-Generated Content

The Platform allows you to post, share, and communicate content ("User Content"). You retain all ownership rights in your User Content, but you grant Oncoo certain rights as described below.

License to Your Content

By posting User Content on the Platform, you grant Oncoo a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with operating and improving the Platform.

Content Standards

All User Content must:

  • Be respectful, supportive, and appropriate for a cancer support community
  • Not contain hate speech, harassment, or discriminatory language
  • Not include personal attacks or bullying
  • Not violate anyone's privacy, publicity, or intellectual property rights
  • Not contain spam, advertising, or promotional content (unless authorized)
  • Be accurate and not misleading

Content Moderation

Oncoo reserves the right (but has no obligation) to:

  • Monitor, review, and moderate User Content
  • Remove or refuse to post any User Content that violates these Terms
  • Take appropriate action against users who violate these Terms
  • Preserve User Content and disclose it if required by law

Important: Oncoo does not endorse any User Content and is not responsible for the accuracy, safety, or legality of User Content posted by others.

5. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

Strictly Prohibited:

  • ❌ Harassment, threats, or intimidation of any user
  • ❌ Posting content that exploits, harms, or attempts to exploit or harm minors
  • ❌ Impersonating any person or entity
  • ❌ Posting false, misleading, or fraudulent content
  • ❌ Transmitting viruses, malware, or any harmful code
  • ❌ Attempting to gain unauthorized access to the Platform or other users' accounts
  • ❌ Collecting or harvesting personal information about other users
  • ❌ Using the Platform for any illegal purpose
  • ❌ Encouraging or facilitating any violations of these Terms

Additional Restrictions

  • Do not promote unverified medical treatments or miracle cures
  • Do not share another user's content outside the Platform without their explicit permission
  • Do not use the Platform primarily for dating or romantic purposes
  • Do not engage in excessive self-promotion or commercial activity
  • Do not disrupt or interfere with the Platform's operation

6. Medical Disclaimer

IMPORTANT MEDICAL DISCLAIMER

The Platform is NOT a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of qualified healthcare professionals regarding any medical condition or treatment.

What Oncoo Is

Oncoo is a peer support community where people affected by cancer can connect, share experiences, and find emotional support.

What Oncoo Is NOT

  • A medical service or healthcare provider
  • A source of medical advice, diagnosis, or treatment recommendations
  • A replacement for professional medical care
  • Staffed by medical professionals (unless explicitly stated)

Community members speak only about their own experiences. Their experiences may differ significantly from yours. Never disregard professional medical advice or delay seeking it because of something you read on the Platform.

In case of emergency: If you are experiencing a medical emergency, call your local emergency services immediately (e.g., 911 in the US, 112 in the EU). Do not rely on the Platform for emergency assistance.

7. Intellectual Property Rights

Oncoo's Rights

The Platform and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof) are owned by Oncoo and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

Trademarks

The Oncoo name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Oncoo. You may not use these marks without our prior written permission.

8. Third-Party Links & Services

The Platform may contain links to third-party websites, applications, or services that are not owned or controlled by Oncoo. Oncoo has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

We do not endorse any third-party content, products, or services. You access third-party sites at your own risk, and you should review their terms and privacy policies.

Social Media Integration

If the Platform integrates with social media platforms (e.g., Facebook, Instagram), your use of those features is governed by the third party's terms of service and privacy policy.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by law, Oncoo disclaims all warranties, express or implied, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the Platform will be uninterrupted, secure, or error-free
  • Warranties regarding the accuracy, reliability, or completeness of any content
  • Warranties that any errors or defects will be corrected

Oncoo does not warrant that the Platform will meet your requirements or that your use will be secure or free from viruses or other harmful components.

10. Limitation of Liability

IMPORTANT LIABILITY LIMITATIONS

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ONCOO, ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.

This includes, but is not limited to, damages for:

  • Loss of profits, data, or use
  • Loss of goodwill or reputation
  • Service interruption or system failures
  • Reliance on information obtained through the Platform
  • Actions or content of other users

Maximum Liability: To the extent permitted by law, Oncoo's total liability to you for all claims arising from your use of the Platform shall not exceed €100 (one hundred euros) or the equivalent in your local currency.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Termination

Your Rights

You may terminate your account at any time by contacting us at support@oncoo.app or using the account deletion feature in your settings.

Our Rights

We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for:

  • Violations of these Terms
  • Fraudulent, harassing, or illegal activity
  • Conduct that harms or could harm other users or Oncoo
  • Extended periods of inactivity
  • Any other reason at our sole discretion

Effect of Termination

Upon termination:

  • Your right to access and use the Platform will immediately cease
  • We may delete your account and all associated data
  • Certain provisions of these Terms will survive termination (including intellectual property rights, disclaimers, and limitations of liability)

12. Governing Law & Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions.

Dispute Resolution

If you have a concern or dispute with Oncoo, we encourage you to first contact us at legal@oncoo.app to seek an informal resolution.

Jurisdiction

Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in [Your Jurisdiction], and you consent to the personal jurisdiction of such courts.

International Users

If you access the Platform from outside Italy, you are responsible for compliance with local laws and acknowledge that you are transferring your personal information to [Your Country].

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

  • Update the "Effective Date" at the top of these Terms
  • Notify you via email (if you provided an email address)
  • Post a prominent notice on the Platform

Your continued use of the Platform after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Platform.

Additional Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Oncoo regarding the Platform and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
